Electronic Network News: On Wednesday, a committee of the U.S. House of Representatives approved a significant proposal that would allow automakers to deploy up to 100,000 autopilot systems for testing without meeting current vehicle safety standards. Additionally, it would prevent states from implementing their own driverless car regulations targeting these test vehicles.
Republican Congressman Robert Latta, who leads a subcommittee under the Energy and Commerce Committee focused on consumer protection, stated that the full committee will vote on the proposal next week. He also mentioned that he plans to review and possibly adjust the proposal before the final vote.
If the proposal passes in the upcoming committee vote, it will then be sent to the full House of Representatives for approval. However, this is expected to happen after September, as the House will be in recess during the summer and won’t reconvene until later in the year.
This proposed legislation marks the first major federal initiative aimed at accelerating the introduction of autonomous vehicles into the market. If passed, automakers would not need to apply for government approval when testing advanced driving technologies—only submit a safety assessment report.
The draft released earlier this week requires automakers to demonstrate that self-driving cars are “normal†and include fail-safe features. However, the Department of Transportation must not impose additional conditions on the deployment or testing of highly automated vehicles when reviewing these reports.
This issue has become increasingly urgent, given that the number of traffic fatalities in the U.S. reached 35,200 in 2015—a 7.7% increase from the previous year. That was the highest annual growth rate in traffic deaths since 1966. Data from the U.S. government also shows an 8% rise in traffic deaths in the first nine months of 2016.
Current U.S. federal auto safety laws prohibit automakers from selling self-driving cars that don’t require manual control. These rules require compliance with nearly 75 vehicle safety standards, many of which assume a licensed driver is always in control.
Companies like General Motors, Alphabet, Ford, and Tesla have been actively lobbying Congress, hoping the federal government will lead the way in creating clear regulations. This is because some states, like California, may impose restrictions on the testing and deployment of autonomous vehicles.
According to the proposal, states can still establish rules regarding registration, licensing, liability, insurance, and safety inspections for self-driving cars. However, they cannot set performance standards for these vehicles.
Auto dealers are also concerned about potential conflicts with existing dealership franchise laws, which often prevent automakers from selling directly to consumers. They hope the final bill will clarify that this change won’t interfere with those state-level regulations.
The Consumer Union criticized the proposal, calling for further revisions. They emphasized that the legislation must ensure automakers can prove the safety of self-driving cars and that consumers aren’t put at greater risk in the event of an accident. The organization also opposes limiting state authority without establishing strong federal safety standards.
Last year, the Obama administration introduced voluntary guidelines for self-driving cars, requiring manufacturers to submit a safety assessment report with 15 questions. Meanwhile, the Trump administration’s Transportation Secretary, Elaine Chao, announced plans to update these guidelines in the coming months.
